Celebrity Justice: District Attorney to Remain On Case of Convicted Beverly Hills Fashion Designer!

by Gabriel Dorman on April 27, 2009

The Los Angeles Times reports that a Los Angeles Superior Court judge denied a motion to remove the Los Angele County District Attorney’s office from the case of Beverly Hills Fashion Designer Anand Jon Alexander who was convicted last year of rape and sexual assault.

Lawyers for Alexander are accusing prosecutors of trying to sabotage their investigation into a juror who allegedly contacted Alexander’s sister during and after the trial. They claim investigators from the District Attorney’s office intercepted the juror in question and interviewed him on January 7 right before he arrived to meet with Alexander’s sister, who was wearing a hidden recording device set up and planted by defense investigators.

In denying the defense motion, Los Angeles Superior Court Judge David S. Wesley said “[t]here was no law broken, there was no misconduct, there was no violation of a court order.” While Judge Wesley did not agree with the conduct, he did not believe that it merited removal of the entire office or even the two prosecutors who tried the case.

It is anticipated that Alexander’s criminal defense lawyers will raise this issue of juror misconduct during a hearing on May 5 to determine if he should be granted a new trial.
