The Los Angeles Times reports that former Orange County Sheriff Michael Corona’s motion to dismiss his conviction for witness tampering was denied Tuesday in federal court.
In ruling against the motion to dismiss, U.S. District Judge Andrew J. Guilford further denied Corona’s request for a new trial. Corona’s criminal defense attorneys argued that the former sheriff was charged and convicted under the wrong statute and, as such, was entitled to a new trial. The court did not see it that way.
The denial of these motions clears the way for Corona’s sentencing which is scheduled for April 27. Corona is the highest ranking law enforement officer to ever be prosecuted in Orange County. He served nine years in his position as sheriff before he was indicted in 2007 on corruption charges. While he was acquitted on 5 of 6 felony counts, he was convicted on one county of witness tampering for trying to influence the testimony of his former Assistant Sheriff Don Haidl during a grand jury investigation into the corruption in his administration.
Probation has already recommended that Corona serve 6 1/2 years in federal prison.
FYI: Corona was dubbed “America’s Sheriff” by CNN’s Larry King after Corona led the efforts to find Samantha Runnion, a 5 year old girl who was kidnapped while playing with a friend outside of her house in Stanton, CA.
