ESPN reports that NFL star Plaxico Burress had his gun case continued by the court today leaving the fate of the New York Giants wide receiver in doubt until June 15 when he is scheduled to be back in court.

Burress’ gun case stems from an incident in which he shot himself in the leg with an unlicensed handgun stuck inside his waistband while in a Manhattan nightclub last year.

While both sides agreed to the continuance, the prosecutor in the case, John Wolfstaetter, advised the judge that the prosecution was still conducting its investigation. Benjamin Brafman, Burress’ criminal defense attorney, told reporters outside that both sides have yet to reach a plea agreement but efforts are conitnuing. He also stated that if an agreement could be reached prior to the next scheduled court date they would not wait that long to get back in court.

It seems as thought Burress really has two battles to fight here. First of course is the court case. Burress is charged with criminal possession of a weapon in the second degree, a felony offense  in New York that carries a minimum sentence of 3 1/2 years if convicted. This is where it gets difficult because any plea deal that includes a jail sentence will seriously impact his ability to play football. The second fight is with the NFL which has been disciplining players very hard for their off-the-field behavior under Commissioner Roger Goodell and the revised player conduct policy. Even if Burress manages to strike a deal that allows him to avoid a jail sentence, his reinstatement to the NFL is in no way a certainty.
