Teen Driver Guilty of Murder in Fatal DUI Crash

by Gabriel Dorman on August 6, 2009

The Orange County Register reports that Milad Moulayi, the Tustin teen driver charged with second degree murder in the fatal DUI crash that killed 16-year-old Mackenzie Frazee, was found guilty today by an Orange County jury.

In finding Milad Moulayi guilty of second degree murder, the jury, in essence, agreed with the prosecution that Moulayi knew that driving under the influence was dangerous to human life but did it anyway.

On August 28, 2008, Moulayi, left a small party at his parents house to take home Mackenzie Frazee when he lost control of the Mercedes he was driving while speeding down Newport Ave. at more than 100 mph and crashed. The force of the impact cut the car in two as it slammed into a concrete lamppost. Mackenzie Frazee died as a result of the crash.

During the trial, prosecutors argued that Moulayi knew that driving that night was dangerous to human life. They had one of Milad Moulayi’s teen classmates testify against him. Jessica Dived testified that she and some other friends repeatedly warned Moulayi that he was too drunk to drive. In addition, prosecutors submitted evidence that Moulayi was warned by a juvenile court judge just hours prior to the fatal DUI crash that driving a car carried “an intense amount of responsibility.”

The North Tustin teen driver showed no emotion as the guilty verdict was read. Moulayi now faces 15 years to life in prison for the fatal DUI crash when he is sentenced on October 2 in Orange County Superior Court.
