Repeat DUI Driver Guilty of Murder for Killing Friend

The Orange County Register reports that a Long Beach repeat DUI driver has been found guilty of murder for killing his friend in another DUI related accident.

Ivan Gandarilla, 25, was found guilty by a jury in Orange County Superior Court of second degree murder after the jury found that he turned his own car into oncoming traffic while driving under the influence resulting in the death of his friend and front passenger Fernando Flores, 29. Gandarilla was charged with what is known as a Watson Murder as a result of his 2005 DUI conviction on the theory of implied malice.

At trial, evidence was presented that DUI driver Gandarilla exited the 605 Freeway at Katella Avenue at about 11:00 p.m. when he suddenly turned left against a red light arrow into oncoming traffic in front of a Chevrolet Tahoe occupied by four people, which was passing legally through the intersection on a green light. The driver of the Tahoe was unable to stop in time to avoid the collision. Sadly, Flores suffered multiple blunt force trauma resulting in his death. Two hours after his arrest, Gandarilla had a blood alcohol concentration of .17%.

As a result of his DUI murder conviction, Gandarilla faces a maximum sentence of 15 years to life in prison when he is sentenced on September 18.
