Pursuant to California Vehicle Code Sections 23582 and 23103, if you are arrested for drunk driving you will be charged with a reckless driving speed enhancement if, at the time you were driving, you were:
- driving 20 mph over the posted speed limit on the street, or;
- driving 30 mph over the posted speed limit on the freeway
The punishment for an excessive speed enhancement is severe and requires that the court impose a mandatory additional term of 60 days in jail. The imposition of the 60 days of jail in not discretionary with the judge, it is mandatory which means it must be ordered by the court and served by you.
