Los Angeles Drug Charge Lawyer: California Drug Crime Laws

Marijuana, cocaine, methamphetamine, crsystal meth, ecstacy, and prescription pain killers such as vicodin, oxycodone and, its cousin, oxycontin, are all out there being used or sold and, as such, prosecuted for those individuals caught doing one or the other. Drug crime prosecutions are some of the most common throughout Los Angeles, Orange County, Riverside, San Bernardino and Ventura County.

The following is a list of the most common California drug laws under which most cases are prosecuted:

  • Possession of A Controlled Substance – Health and Safety Code Section 11350
  • Possession for Sale of A Controlled Substance - Health and Safety Code Section 11351
  • Sales or Transportation of A Controlled Substance – Health and Safety Code Section 11352
  • Possession of Methamphetamine – Health and Safety Code Section 11377

Fortunately, for non-violent drug users, California offers the opportunity to avoid jail sentences and, in some instances, have their cases dismissed through participation in court ordered drug treatment programs such as PC 1000 (Deferred Entry of Judgment) or Prop. 36. However, these programs are not normally an option for individual’s charged with drug sales or dealing narcotics. I say normally because, depending on the facts of the case, an experienced criminal defense drug attorney can make drug diversion an option where it otherwise, wouldn’t be one.
