The discovery motions seek information regarding the unauthorized release of the photo showing an injured Rihanna which was posted on TMZ. Geragos believes the photo was leaked by an LAPD officer. In his motion, Geragos writes:

“…this highly prejudicial photograph was sold by an LAPD officer to the entertainment website, Thirty Mile Zone (TMZ). The photograph was immediately viewed by hundreds of thousands of viewers and was plastered on every news channel for the following weeks.”

Geragos is seeking all written statements and reports from the LAPD regarding the photo of Rihanna. Specifically, this would include notes from the Internal Affairs investigation and any police officer notes and other documents.

Geragos states he intends to use this information to attack the credibility of the police officer(s) at the preliminary hearing. He believes that if can prove the police lack credibility, the court will likely dismiss the case at the preliminary hearing.
